Shopently terms of service

Rules for using a Shopently account, launching and operating online stores, and paying for platform services.

1. Service provider and contact

Shopently services are provided by ALLIT MATEUSZ WRÓBLEWSKI, ul. Aleksandra Sochaczewskiego 4/81, 96-500 Sochaczew, Poland, tax identification number (NIP) 8371873962, business register number (REGON) 522346800, referred to as “Shopently” or the “Provider”.

2. Scope of the services

Shopently provides a software-as-a-service platform for creating, configuring and operating online stores. Depending on the plan, it includes a customer account, store dashboard, application and data hosting, themes, add-ons, domain support and sales tools.

The detailed scope, limits, price and billing period of a plan are shown before an order is placed. Features marked as experimental or upcoming are not a guaranteed part of a plan until made available as active features.

3. Accounts and permissions

Users must provide accurate, current information and protect their password and email account. Registration through Google is an optional authentication method and requires a Google account.

A store owner is responsible for employees and administrators granted access and for their permissions. Actions performed through a properly authenticated account are treated as actions of its user unless Shopently is promptly notified that the account has been compromised.

  • An account must not be shared with unauthorised persons or used to bypass platform limits and safeguards.
  • Suspected account compromise must be reported promptly to support@shopently.com.

4. Technical requirements

The service requires a current web browser, Internet access, an active email address, cookies and JavaScript. The customer is responsible for their devices, connection, domain and configuration of third-party services.

5. Plans, prices and payments

Prices are displayed before purchase together with information on whether tax is included. Online payments are handled by an external payment provider, in particular Przelewy24 (PayPro S.A.). Shopently does not store full payment card details.

A subscription remains valid for the paid period. Renewing or changing a plan requires an appropriate order. The checkout shows the settlement rules, amount and new term before payment.

Plan limits, including product count, file storage and computing resources, form part of the offer. Once a limit is reached, Shopently may prevent new data from being added or offer a plan change, without deleting existing data solely for that reason.

6. Store activation and domain

Once payment is confirmed, Shopently starts automated store provisioning. Activation time may depend on infrastructure capacity, the domain and third-party services.

The customer is responsible for rights to their domain and for configuring DNS records according to the dashboard instructions. DNS propagation and the operation of an external registrar are outside Shopently's control.

7. Customer content and acceptable use

The customer retains rights to products, images, descriptions, trade marks and other materials they provide. The customer grants Shopently a non-exclusive technical licence limited to hosting, processing, backup copying and publicly displaying those materials in the customer's store.

The customer is responsible for the legality of their store, offers and content, including their own store terms, consumer information, taxes, intellectual property rights and the legal basis for processing their customers' data.

  • Illegal content, infringement of third-party rights, malicious software and activity threatening platform security or availability are prohibited.
  • Shopently may restrict specified content or a store where required by law or necessary to remove a genuine threat, with notice to the customer where legally permitted.

8. Availability, maintenance and security

Shopently operates the service with professional care, applies security updates and maintains operational backups. Backups support service recovery and do not replace exports made by the customer.

Technical interruptions may occur due to maintenance, updates, failures or third-party providers. Planned work with a material impact will be announced in advance where reasonably possible.

9. Term, suspension and termination

A store agreement lasts for the paid period. If the subscription is not renewed, the store may remain available for a grace period of up to 38 hours and may then be suspended. The store and its data may be permanently deleted 31 days after the paid period ends.

The customer should export required data before deletion. Data may remain for a limited period in rotating backups, while billing records and data needed to establish or defend claims are retained as required by law.

Shopently may terminate or suspend the service for a material breach of these terms, law, security or payment obligations. Where the nature of the breach permits, the customer will be given an opportunity to remedy it.

10. Consumers

A consumer entering into a distance contract generally has 14 days to withdraw without giving a reason. The statement may be sent to support@shopently.com.

If the consumer expressly requests performance to begin before the withdrawal period ends, they may have to pay a proportionate amount for services supplied before withdrawal. The right of withdrawal expires after full performance only where prior express consent and acknowledgement of the loss of that right have been provided.

These terms do not restrict mandatory consumer rights, including rights concerning conformity of a digital service with the contract.

11. Complaints and liability

A complaint should identify the account or store and describe the issue and requested resolution. It may be sent to support@shopently.com. Consumer complaints are handled within the period required by law, generally no later than 14 days.

Shopently is liable under applicable law. For customers who are not consumers, liability for loss of profit is excluded to the extent permitted by law and aggregate liability for ordinary loss is limited to service fees paid in the 12 months preceding the event. These limits do not apply to intentional damage or where liability cannot legally be limited.

12. Changes and governing law

Shopently may amend these terms for valid reasons, including changes in law, features, security, billing or infrastructure. Customers with an ongoing agreement will receive appropriate advance notice and earlier versions will be archived.

Polish law applies. This choice does not deprive consumers of mandatory protection under the law of their country of habitual residence. Disputes with businesses are subject to the court competent for the Provider's registered place of business unless mandatory law provides otherwise.
